Acceptance of Terms
GoPC Pty Ltd ("GoPC") provides its RainDrop service subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. In addition, when using RainDrop services, you and GoPC shall be subject to any posted guidelines or rules applicable to such services which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS.
Description of Service
RainDrop currently provides users with access to a secured web browsing service (the "Service"). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new RainDrop properties, shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that GoPC assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.
Payment for services are charged in advance of the service. Unless stipulated, no refund is provided on the service. The company reserves the right to adjust pricing of any services at its discretion.
No Resale of Service
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service without the prior consent of GoPC. If you would like to become a GoPC Business Partner, please contact us.
General Practices Regarding Use
In using the service you agree that GoPC may establish general practices and limits concerning use of the Service. This may include the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree to GoPC's "Fair Use Policy" and that GoPC has the right to restrict access to users who are abusing the system beyond reasonable levels. You further agree that GoPC reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
Quality of Services Across The Internet
The RainDrop service is transmitted via the Internet. The quality of the customers Internet link is important to the quality of service experienced. This may vary from one location to another, or from one ISP to another. It is the customer's responsibility to assure adequate bandwidth, connection speed, and latency across the link to the RainDrop service. Please check with your Reseller or PC Support person to ensure that you are connecting to the right data centre for your region.
Recognising the global nature of the Internet, you agree to comply with all local laws regarding online conduct and acceptable Content and/or files. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from Australia, New Zealand or the country in which you reside.
How to Get Help and The Boundaries of Responsibility
RainDrop is an extremely reliable, state-of-the-art system supporting a large number of concurrent users. If you do experience a problem it is likely the issue may be affected by the number of applications open on your computer or the configuration of your local PC, local network or local Internet connection. The FAQ and On-Line Help address most PC issues encountered by others previously but you can also contact us directly. Depending on your area we may put you in touch with a qualified RainDrop support engineer if you need on-site help.
The Nature of The Service
RainDrop as a hosted on-line service providing access to a number of pre-configured software applications for use by individuals. Most of the software applications licenses are Open Source or are paid for by us. If a customer installs software with licensing requirements then that customer acknowledges that the company is not responsible for those licenses and the customer themselves is responsible for licenses costs to operate the software legally. GoPC will not accept liability for software license infringements as this is the responsibility of the customer.
The customer agrees to use the RainDrop service for legitimate and legal purposes only. The customer is subject to the laws of the country in which they operate the system from and the laws of the country in which their RainDrop data centre resides.
RainDrop management reserve the right to suspend a service at its discretion.
A customer's service may be terminated without refund where a RainDrop customer uses the service inappropriately or illegally. We will not allow the system to be used for transmitting unsolicited bulk email (Spam), Ping Floods or any Network Attacks. A service may also be terminated for failure to pay for the service. GoPC management do not promote or condone illegal acts, such as software or music piracy, and we subscribe to an acceptable use policy.
We do not recommend RainDrop is used for downloading files such as movies and music. The system architecture is not designed for music or videos which will still need to be downloaded to your local machine to run well. RainDrop is ideally suited for doing your work and browsing websites.
We use the highest level of encryption and security technology that we have available to us so that any data traversing the Internet is fully encrypted. Most security risk however is attributed to the way users manage their information and access their accounts. We strongly recommend that our customers never share their account with other people, nor divulge or write down their login details anywhere. Security requirements are constantly changing and as a result we cannot provide a guarantee.
